Outcome

The LBC initially rejected the petition for borough incorporation. The petitioners appealed the LBC's decision to the Alaska Superior Court, which remanded the matter back to the LBC for reconsideration, due to a finding that the LBC had not promulgated the decision in accordance with the Administrative Procedures Act. Upon remand, the LBC narrowly voted to approve the petition, and incorporation was approved by the voters.
